PBG has been retained by The Association for American Railroads for these positions.

PBG is currently partnering with The Association of American Railroads to recruit two attorneys to be responsible for a combination of the following substantive areas:

· Economic regulation

· Antitrust

· Commercial contracting

· Amicus practice

· Intellectual property

· Litigation (usually as a 3rd party)

· Torts/FELA

The primary functions will include a combination of the following, depending on the candidate’s experience:

  • Prepare and file (or supervise the preparation and filing by outside counsel) amicus briefs on industry-wide matters of concern, including but not limited to FELA, preemption, and tort matters, and such other matters as may be requested by AAR
  • railroad members.
  • Provide advice and counsel to AAR and its subsidiary MxV Rail regarding:
  • Commercial matters (including contracting).
  • Intellectual property matters.
  • Litigation matters, including but not limited to supervision of compliance with
  • party and non-party discovery obligations; and
  • Document retention policies and compliance.
  • To assist in the development of policy positions and to lead and/or support advocacy
  • on behalf of AAR’s members with regard to economic regulation of the industry, and
  • other matters within the jurisdiction of the Surface Transportation Board (“STB”); and
  • Oversee antitrust policy and compliance and provide antitrust counselling and training
  • to employees of AAR and its subsidiaries, as well as to AAR’s committees, which,
  • among other things, develop and implement industry standards and rules.

Minimum requirements:

  • J.D. from an accredited law school and at least of five years of relevant legal experience.
  • Admission to the D.C. Bar.
  • Excellent analytical, organizational, and written and oral communication skills.
  • Ability to work collaboratively and effectively with internal clients and AAR member representatives.
  • Ability to work independently, be proactive in identifying matters warranting legal counsel, exercise sound judgments with limited supervision, but report to/seek guidance from SVP Law when appropriate.
  • Highest ethical standards and degree of professionalism.

Prior employment as an attorney at an AmLaw 200 firm, with a practice focused on one or more of the following substantive areas is strongly preferred:

· Experience with private standard-setting bodies.

· Prior employment at or representation of a freight or passenger railroad.

· Familiarity with the railroad industry and/or railroad operations.

These are full-time positions located in Washington, D.C. and are eligible for up to two days a week of telework.
